Submitting a form through the Website does not guarantee a booking, delivery, service time, service availability, fuel availability, price, or acceptance of your request.

A service request is not confirmed until Topped Fuel expressly accepts or confirms it through an authorized representative or applicable customer management system.

Actual services may be governed by separate estimates, quotes, service agreements, account terms, credit arrangements, invoices, policies, rental agreements, delivery terms, or other agreements between you and Topped Fuel.

If a separate agreement governing actual Topped Fuel services conflicts with these Website Terms, the applicable service-specific agreement will control with respect to those services.

Topped Fuel currently provides services within Texas.

Unless authorized by us in writing or otherwise permitted by law, you may not reproduce, distribute, copy, modify, publish, transmit, display, commercially exploit, create derivative works from, or otherwise misuse Website content or Topped Fuel intellectual property.

No license, ownership interest, or other intellectual property right is granted merely through your use of the Website.

The Website may link to third-party websites, social media services, customer portals, customer management systems, mapping services, payment or account platforms, or other independently operated resources.

TOPPED FUEL DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, FREE FROM HARMFUL COMPONENTS, OR THAT ALL WEBSITE INFORMATION WILL ALWAYS BE COMPLETE OR CURRENT.

Nothing in this section modifies any express warranty or contractual obligation contained in a separate written agreement between Topped Fuel and a customer.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TOPPED FUEL AND ITS OWNERS, OFFICERS, EMPLOYEES, REPRESENTATIVES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE WEBSITE.

THIS LIMITATION RELATES TO USE OF THE WEBSITE AND IS NOT INTENDED TO ALTER LIABILITY THAT MAY EXIST UNDER A SEPARATE WRITTEN AGREEMENT GOVERNING ACTUAL FUEL DELIVERY OR OTHER TOPPED FUEL SERVICES.

13. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Topped Fuel and its owners, officers, employees, representatives, contractors, and affiliates from claims, losses, liabilities, damages, and reasonable expenses arising from:

  • Your material violation of these Terms

  • Information you knowingly submit through the Website that is false, fraudulent, or unlawful

  • Your infringement or violation of another person’s rights

Subject to applicable law, any legal action arising specifically from these Website Terms or use of the Website shall be brought in a court of competent jurisdiction located in Victoria County, Texas, and you consent to the jurisdiction of those courts.

This provision does not supersede a governing-law, venue, arbitration, or dispute-resolution provision contained in a separate written agreement governing Topped Fuel services.

18. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

19. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

20. Entire Agreement Regarding Website Use

These Terms, together with our Privacy Policy and any other Website policies expressly incorporated into them, constitute the agreement between you and Topped Fuel concerning your use of the Website.

These Terms do not replace separate agreements governing fuel delivery, customer accounts, fuel pod rentals, equipment, payment, credit, scheduling, cancellation, site access, or other Topped Fuel services.
